1. DEFINITIONS

1.1 “Company” means ISolvX LLP, its affiliates, employees, representatives, and successors.

1.2 “Platform” means the Company’s website www.study100on100.com and the mobile application Study 100 on 100.

1.3 “User” means any parent, guardian, teacher, or student who accesses or uses the Platform.

1.4 “Data Principal” refers to the individual (including children) whose personal data is collected, represented by their parent/guardian in accordance with Indian law.

1.5 “Services” refers to all educational, technological, and support services offered through the Platform.

1.6 “Authorized Service Providers” means third-party entities lawfully engaged by the Company to assist in operations, sales, database management, and customer support.

2. ACCEPTANCE OF TERMS

2.1 By accessing or using the Platform, the User expressly agrees to be bound by these Terms, the Privacy Policy, and the Refund & Cancellation Policy, which together constitute a legally binding agreement under the Indian Contract Act, 1872.

2.2 If a User does not agree to these Terms, the User must immediately discontinue use of the Platform.

3. ELIGIBILITY AND PARENTAL RESPONSIBILITY

3.1 The Platform is intended for learners below 18 years of age; however, accounts may only be created and managed by parents or legal guardians.

3.2 The Parent/Guardian represents and warrants that:

  • (a) They are legally competent to contract under Indian law;
  • (b) They have lawful authority to provide consent for their child’s use of the Platform;
  • (c) They shall remain responsible for monitoring the child’s activity and compliance with these Terms.

4. USER OBLIGATIONS

4.1 Users undertake not to:

  • (a) Provide false or misleading information;
  • (b) Engage in any unlawful, fraudulent, or harmful activity;
  • (c) Infringe intellectual property rights of the Company or third parties;
  • (d) Circumvent security measures or disrupt Platform operations.

4.2 The User acknowledges that breach of these obligations may result in suspension or termination of access, without prejudice to the Company’s right to seek damages.

5. SERVICES

5.1 The Company shall provide Services including but not limited to:

  • AI-powered personalized learning modules.
  • Pre-read lessons, notes correction, auto-evaluation.
  • Competitive exam practice (NEET, JEE, etc.).
  • Educational games, comics, cultural and heritage content.
  • Learning through images, videos, and Do It Yourself ideas.
  • Parent and teacher tools, analytics, and reports.

5.2 The Company reserves the right to modify, enhance, or discontinue any Service at its sole discretion. In such cases, parents will be either offered a different service or refunded unused money, as mutually agreed upon between the User and the Company.

6. SUBSCRIPTIONS AND PAYMENTS

6.1 Certain Services require payment of subscription fees, payable in advance through authorized payment channels.

6.2 All payments are governed by the Refund & Cancellation Policy.

6.3 The Company reserves the right to revise fees without any negative impact on the existing subscribers.

7. INTELLECTUAL PROPERTY

7.1 All intellectual property rights in the Platform, including but not limited to content, software, designs, AI outputs, and trademarks, are owned by or licensed to the Company.

7.2 The User is granted a limited, revocable, non-exclusive license to use the Platform solely for personal, educational purposes.

7.3 Any unauthorized reproduction, commercial exploitation, or redistribution shall constitute infringement and may attract civil and criminal liability under Indian law.

8. DATA PROTECTION AND PRIVACY

8.1 The Company shall act as a Data Fiduciary under the Digital Personal Data Protection Act, 2023, and process personal data in accordance with its Privacy Policy.

8.2 By using the Platform, the User expressly consents to such processing, including the engagement of Authorized Service Providers for operational, sales, and customer support purposes.

9. INDEMNITY

The User (Parent/Guardian) agrees to indemnify, defend, and hold harmless the Company from any claims, liabilities, damages, penalties, or costs arising out of:

  • (a) False or inaccurate data provided by the User;
  • (b) Unauthorized or unlawful use of the Platform;
  • (c) Breach of these Terms or applicable laws by the User or the child under their supervision.

10. LIMITATION OF LIABILITY

10.1 The Platform and Services are provided on an “as is” basis, without warranties of accuracy or guaranteed outcomes.

10.2 The Company does not warrant success in academic or competitive examinations.

10.3 To the fullest extent permitted by law, the Company’s liability shall be limited to the subscription fees paid by the User in the twelve (12) months immediately preceding the claim.

11. TERMINATION

11.1 The Company reserves the right to suspend or terminate User access if:

  • (a) The User breaches these Terms;
  • (b) The User engages in unlawful or fraudulent activity;
  • (c) Required by law or regulatory authority.

11.2 Termination shall be without prejudice to the Company’s right to claim damages.

12. GOVERNING LAW AND JURISDICTION

12.1 These Terms shall be governed by and construed in accordance with the laws of India.

12.2 All disputes shall be subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka, India.

13. AMENDMENTS

The Company reserves the right to amend or update these Terms at its sole discretion. Continued use of the Platform after such amendments shall constitute binding acceptance.
