1. Definitions:
1.1 “Company” means ISolvX LLP, including its affiliates, employees, representatives, and successors.
1.2 “Platform” means the website www.study100on100.com and the mobile application Study 100 on 100.
1.3 “User” means any parent, guardian, or other lawful subscriber of the Platform’s paid services.
1.4 “Subscription” means the paid services offered by the Company for a defined duration (monthly, quarterly, annually, or otherwise).
1.5 “Authorized Payment Gateway” means a payment processor officially integrated with the Platform for processing fees.
2. Scope and Application: This Refund and Cancellation Policy (“Policy”) governs all paid transactions conducted through the Platform and shall form part of the legally binding agreement between the User and the Company under the Indian Contract Act, 1872. This Policy shall be read in conjunction with the Terms & Conditions of Use and Privacy Policy.
3. Cancellations by Users:
3.1 A User may cancel a Subscription at any time by submitting a request through the Platform or by contacting the Company at its official support email.
3.2 Cancellation shall be effective at the end of the then-current billing cycle. The User shall continue to have access until the expiry of such cycle.
3.3 The Company expressly disclaims any obligation to provide prorated or partial refunds for cancellations made during an active billing period.
4. Refunds:
4.1 All payments made to the Company are non-refundable, except in the following limited circumstances:
(a) Duplicate Payment: If a User has been charged more than once for the same transaction.
(b) Technical Error: If a transaction fails due to a technical fault but the User’s account is nevertheless debited.
(c) Service Non-Activation: If a paid subscription is not activated within seven (7) working days of successful payment confirmation.
4.2 Refunds, where approved, shall be processed only to the original payment method within 7–14 working days, subject to banking and payment gateway timelines.
5. Discretionary Refunds: The Company may, at its sole discretion, consider refunds in exceptional cases where substantial deficiency in service is established under the Consumer Protection Act, 2019. Any discretionary refund provided shall not create a precedent or obligation for future refunds.
6. Cancellations or Terminations by the Company:
6.1 The Company reserves the right to cancel or suspend a User’s Subscription if:
(a) The User breaches the Terms & Conditions;
(b) The User engages in fraud, misuse, or unlawful activity;
(c) Required by law, regulation, or government authority.
6.2 In such cases, the User shall not be entitled to any refund of fees already paid.
7. Payments Through Unauthorized Channels:
7.1 The Company shall not be liable for any payments made through unauthorized or unofficial channels.
7.2 Refunds shall only be processed for transactions made via Authorized Payment Gateways listed on the Platform.
8. Limitation of Liability:
8.1 To the fullest extent permitted by law, the Company’s liability under this Policy shall be limited to the actual amount of subscription fees paid by the User.
8.2 The Company shall not be liable for:
(a) Delays caused by banks, payment gateways, or third-party processors;
(b) Losses due to User error (e.g., providing incorrect account/payment details);
(c) Indirect, consequential, or incidental damages arising from cancellations or refunds.
9. Governing Law and Jurisdiction: This Policy shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
